Blue File strengthens its offer to freight transport professionals

On July 10, 2014, a new law (n°2014-790) aimed at reinforcing the responsibility of contracting authorities and principals in the context of subcontracting and combating social dumping and unfair competition was enacted.
This new provision is particularly welcome in the transport sector.

In the event of the secondment of workers by an employer, the principal is obliged to check that the employees seconded by his co-contractor have been declared to the labor inspectorate at the place where the service begins.
Companies based in France must check that their co-contractors have fulfilled this obligation, and must keep a copy of the declaration, attaching it to the single personnel register. In this way, French companies play an active role in monitoring the conditions under which foreign employees are seconded to their sites, particularly with regard to wages and working hours.

In the event of an administrative inspection, if the contractor has breached at least one of these obligations, the simple omission of verification will result in an administrative fine for the customer.
